What is Trucker’s  Occupational Accident?
Trucker’s Occupational Accident (Occ/Acc)  is designed specifically for Owner Operators, Co-Drivers and Independent Contractors.  Coverage is provided for on-the-job injuries. Limited coverage is also included for no-work related claims.

What type of coverage does Occ/Acc insurance provide?

  1. Accidental Death & Dismembership: a benefit paid monthly to the owner-operator or their beneficiary in the event of the loss of use or certain body parts; or, their death.
  2. Medical: when a covered driver is involved in an accident requiring medical treatment, within 90 days of the date of the accident causing the covered injury, the coverage will pay for the medical costs up to the limits of the policy for two (2) years. Hernia and hemorrhoid coverage is included.
  3. Disability: in the event a covered injury resulting in an inability for the owner-operator to work during the time they are recovering from the covered injury, the policy will pay a temporary or continuous total disability wage replacement benefit.
  4. Passenger Accident and Casual Laborer Coverage available upon request

What is Contingent Liability?
CL, Contingent Liability, coverage pays legal expenses, incurred defending the Independent Contractor status.  CL will defend any reclassification claim, proceeding or suit against the Participant Sponsor.  CL will pay up to the limits of liability, on behalf of the Participant Sponsor, for the benefits that Participant Sponsor is required to pay under the Workers’ Compensation laws of a given/particular state.  It is on a “Pay on Behalf” basis, as opposed to a “Reimbursement” policy, if the Independent Contractor is reclassified to Employee status.

Does Occupational Accident coverage replace Worker's Compensation?
No, this is not a policy of Worker's Compensation insurance.  This policy does not cover disease, unless otherwise noted.

Is the Medical insurance, with Pan-American Life Insurance Company, a primary or secondary form of coverage?

The medical coverage, provided by this Occ/Acc policy, is secondary ONLY if you have a Medical insurance plan that will cover work-related injuries.  Most Medical insurance policies do not cover work-related injuries.  If your Medical insurance policy does cover work-related injuries, then your  Occ/Acc policy will cover any out-of-pocket costs, such as co-pays or deductibles.

Occupational Accident Insurance products that GWI offers are through what carrier?

GWI underwrites Occupational Accident Insurance products, for Independent Contractors, on behalf of Pan-American Life Insurance Company.

This is not a policy of workers’ compensation insurance. The employer does not become a subscriber to the workers’ compensation system by purchasing this policy, and if the employer is a non-subscriber, the employer loses these benefits which would otherwise accrue under the workers’ compensation laws. The employer must comply with the worker’s compensation law as it pertains to non-subscribers and the required notifications that must be filed and posted.
