Understanding Primary Employer’s Indemnity Insurance

Primary Employer’s Indemnity coverage, or PEI, is currently available in Texas only and designed for nonsubscribing employers who choose to opt out of the workers’ compensation system. The program reimburses the employer for amounts the employer becomes legally obligated to pay, subject to terms and conditions of the policy and its limits of liability related to bodily injury damages that arise from a claim of workplace negligence by a covered individual, or by the covered individual’s immediate family member (spouse or children). The plan will reimburse, in excess of the self insured retention, all reasonable amounts paid to obtain a release of liability. Defense costs as well as mediation and arbitration costs are unlimited and covered outside the policy limits.

This is not a policy of workers’ compensation insurance. The employer does not become a subscriber to the workers’ compensation system by purchasing this policy, and if the employer is a non-subscriber, the employer loses these benefits which would otherwise accrue under the workers’ compensation laws. The employer must comply with the worker’s compensation law as it pertains to non-subscribers and the required notifications that must be filed and posted.
